Terms of Service.
These Terms of Service (“Terms”) govern your access to and use of carma-performance.com (the “Site”) and your purchase of products and services from Carma Performance (“Carma,” “we,” “us,” or “our”). By using the Site or purchasing from us, you agree to these Terms.
1. Acceptance of These Terms
By accessing the Site, placing an order, or having us perform work, you agree to be bound by these Terms and by our Privacy Policy, Refund & Return Policy, and Off-Road & Vehicle Modification Disclaimer, which are incorporated by reference. If you do not agree, do not use the Site or purchase from us.
2. Our Services
Carma Performance provides automotive performance products and services, which may include ECU and flash tuning, custom dyno tuning, CNC cylinder head porting, engine builds, custom fabrication, and related parts and labor.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to purchase from us. By purchasing, you represent that you are the owner of the vehicle or are authorized to authorize work on it.
4. Orders, Quotes & Pricing
Prices, quotes, and estimates are subject to change and may expire. We make reasonable efforts to display accurate pricing, but errors may occur; if a product or service is listed at an incorrect price, we may cancel the order and refund any amount charged. We reserve the right to refuse or cancel any order. Applicable taxes and fees may be added at checkout.
5. Payment & Authorization
Payments are processed through Shopify Payments. By submitting an order, you authorize us and our processor to charge your selected payment method for the total amount, including any applicable taxes and deposits. Deposits and the cancellation of orders are governed by our Refund & Return Policy.
6. Appointments & Scheduling
Service appointments are scheduled in advance. You are responsible for delivering your vehicle to our facility at the agreed time and for providing accurate information about the vehicle. Cancellations and reschedules are governed by our Refund & Return Policy.
7. Nature of Performance Services & Assumption of Risk
Performance tuning, modification, and engine work increase stress on vehicle components and carry inherent risks, including the risk of mechanical failure or damage to your engine, transmission, or driveline. By purchasing, you acknowledge and voluntarily assume these risks. Our Off-Road & Vehicle Modification Disclaimer applies to all performance products and services and forms part of these Terms.
8. Vehicle Condition & Your Responsibilities
- You represent that your vehicle is in sound mechanical condition suitable for the requested work;
- You agree to disclose known pre-existing conditions, prior modifications, and mechanical issues;
- Pre-existing conditions may affect results and are not our responsibility;
- You are responsible for removing personal belongings from the vehicle; we are not liable for items left inside;
- Vehicles not picked up within a reasonable time after work is completed may incur storage fees and may be subject to a mechanic’s lien as permitted by Tennessee law.
9. Tune Files & Calibration License
Any tune file, calibration, or software we provide is licensed to you for use on your specific vehicle, not sold. You may not copy, redistribute, resell, reverse-engineer, or transfer it. All calibrations and related intellectual property remain the property of Carma Performance.
10. Warranties & Disclaimer of Warranties
We perform services with reasonable care and skill. Except as expressly stated in writing, and to the fullest extent permitted by law, all products and services are provided “AS IS” and “AS AVAILABLE,” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Modifying your vehicle may void or affect your manufacturer’s warranty; see our Disclaimer.
11. Limitation of Liability
To the fullest extent permitted by law, Carma Performance will not be liable for any indirect, incidental, special, or consequential damages, or for loss of use, arising out of or related to our products or services. Our total liability for any claim will not exceed the amount you paid for the specific product or service giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Carma Performance and its owners and employees from any claims, damages, or expenses arising out of your misuse of products or services, your violation of these Terms, or your operation of a modified vehicle in violation of applicable law.
13. Intellectual Property
The Site and its content — including text, graphics, logos, and images — are owned by or licensed to Carma Performance and are protected by law. You may not use them without our written permission.
14. Third-Party Services & Links
The Site relies on third-party services (such as Shopify and mapping providers) and may link to third-party sites. We are not responsible for the content, products, or practices of third parties.
15. Governing Law & Venue
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Davidson County, Tennessee, and you consent to their jurisdiction.
16. Dispute Resolution
Before filing any claim, you agree to first contact us at sales@carma-performance.com so we can try to resolve the matter informally. Most concerns can be resolved this way.
17. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted, and the “Last updated” date above will reflect the latest revision. Your continued use of the Site or our services after changes are posted constitutes acceptance.
18. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with the policies referenced above, are the entire agreement between you and Carma Performance regarding the Site and your purchases.
