Please read this Disclaimer carefully. It applies to all performance products, calibrations, tunes, and services provided by Carma Performance and forms part of our Terms of Service.
1. Competition & Off-Road Use
Certain products, calibrations, and services we offer are designed and intended solely for closed-course competition and off-road use. They may not be legal for use on public roads or highways, or on emissions-controlled vehicles operated on public roads, in some jurisdictions.
2. Emissions & Legal Compliance — Your Responsibility
It is solely your responsibility to know and comply with all applicable federal, state, and local laws and regulations governing your vehicle, including the federal Clean Air Act, U.S. EPA regulations, and emissions and vehicle-inspection requirements in your area. Carma Performance does not represent or warrant that any product, calibration, or modification is compliant with such laws for on-road use. You are responsible for how and where you use your vehicle.
3. Manufacturer’s Warranty
Modifying your vehicle’s ECU, engine, drivetrain, or other systems may void or affect your manufacturer’s warranty. Carma Performance is not responsible for any loss of, or change to, manufacturer warranty coverage resulting from work we perform or products we provide.
4. Assumption of Risk
Performance tuning and modification increase output and place additional stress on vehicle components. This carries inherent risks, including the risk of mechanical failure or damage to your engine, transmission, driveline, or other components. By purchasing, you voluntarily and knowingly assume all such risks.
5. No Liability for Consequential Damage
To the fullest extent permitted by law, Carma Performance is not liable for any damage to your vehicle or its components, or for any incidental or consequential damages, arising out of performance modifications, tuning, or use of your modified vehicle, except as expressly required by law.
6. Vehicle Condition
Performance work assumes your vehicle is in sound mechanical condition. You represent that your vehicle is mechanically sound and suitable for the requested work. Pre-existing wear, defects, or prior modifications may affect results and the safety of the work, and are not the responsibility of Carma Performance.
7. Safe & Lawful Operation
You agree to operate your vehicle safely and lawfully at all times, and to use any competition or off-road products only in appropriate, lawful settings. Carma Performance does not condone or encourage unsafe or unlawful operation of any vehicle on public roads.
